The research concludes that the cases where expropriation must be exhaustively stated in the Act. The affected by this figure should receive fair compensation. It must tend to a direct arrangement between the expropriating authority and the owner of the property, not to get to trial. The process of expropriation must be agile and can not be an instrument of abuse of power. In the research process several resources, mainly the consultation of books, theses, papers, expert testimony, websites, etc. were used There was significant personal contribution. |

Permite conocer el procedimiento expropiatorio, con el propósito mediato de que sea útil para todos quienes tengan interés sobre esta acción estrictamente jurídica. El estudio presenta varios conceptos de expropiación, determina sus elementos. Se refiere a la diferencia que existe con otras figuras legales. Trata sobre la regulación de la Expropiación que hace el COOTAD. La investigación concluye que los casos en los que procede la expropiación deben constar en forma taxativa en la Ley. El afectado por esta figura debe percibir una indemnización justa. Se debe propender a un arreglo directo entre el órgano expropiante y el propietario del bien, para no llegar al juicio. El trámite de expropiación debe ser ágil y no puede constituir un instrumento de abuso de poder.
