En la investigación de delitos reúne una importancia sin límites contribuyendo a esclarecer en gran medida los hechos delictivos, sus autores y cómplices. Para ello el ordenamiento ecuatoriano debe ceder paso a la obtención indirecta de dicha prueba, cuando no se cuenta con el consentimiento de la persona involucrada, sin que ello signifique una violación de sus derechos fundamentales como la objeción de conciencia, la intimidad o la dignidad.
