Opis
Izvleček:The present work of curricular integration is entitled: ''Comparative doctrinal legal study of the inclusion of natural persons for obtaining licenses in the hemp business to have the right to a dignified life'', the same that arises the interest to investigate since after the legalization of non-psychoactive cannabis, to be able to work only legal persons are granted licenses and not natural persons, generating an exclusion that the authorities have not been able to justify. With the present work I have been able to detect that the constitutional right to carry out economic activities individually or collectively has not been respected, given that by not allowing natural persons to obtain licenses, this and other fundamental rights that help human beings to have a better lifestyle are being violated, despite the fact that countries such as Uruguay, Colombia and Argentina with whom I carry out my comparative analysis allow the participation of natural persons, giving them greater facility to undertake than legal persons. Ecuador does not have a law that regulates self-cultivation for medicinal or recreational purposes, in view of such regulatory progress it has been done in a very closed and controlling way, according to this legal analysis it is presumed that in order to avoid future situations of illegality, although the only thing that has been legalized in the non- psychoactive cannabis is that which does not contain the compound that causes addiction which is used for recreational effects that have caused much damage to society. Given the geographic location of Ecuador, the main activity to be developed and the one that would generate the greatest amount of economic income is the cultivation, which does not require great agricultural knowledge or special care for its development, which means that anyone interested in undertaking this new business can do it and obtain great economic benefits very easily. However, the Ministry of Agriculture, when issuing the respective regulations, has excluded the possibility that natural persons can work, regardless of the activity to be developed, generating a greater social inequality between rich and poor.
