| Итог: | The present thesis entitled: "Modification to the Ecuadorian Criminal Regime to ensure the overcoming of the disturbance and social inclusion of people with symptoms of mental disorder responsible for crimes", is based on the violation of the right to unimputable people suffering from mental disorder, so it is not complied with what is established in the criminal legislation, which is the overcoming of the disturbance and social inclusion. Within our country, there is a constitutional norm in which the right to health is guaranteed as a primary duty and criminal norms that establish security measures for people who are suffering from a mental disorder; but this legislation is not enough to comply with what is proposed by our Organic Comprehensive Criminal Code therefore I consider that this law should be extended its rules of the offenders unimputable because it has been breaching the established by the lack of determination in the measures of security. We are showing within our country a violation of rights to people suffering from mental disorder who have broken the law, so there are several cases where these people are in detention centers, where they are not treated adequate and fair, where the established laws are violated, and mainly their right to be imputable. People suffering from mental disorder who have committed crimes within our country should be treated in specific spaces, and have the interdisciplinary medical team, and also taking into account that the security measure must be based on the principle of proportionality, ie that their security measure is commensurate with the crime committed, in order to enforce their rights and achieve the overcoming of the disturbance they have and the social inclusion which is established within the Criminal Legislation. |
