Considering that this legal provision is not currently codified in Ecuadorian law, it is important to define it in the context of ensuring effective judicial protection for the parties and preventing the violation of the right to legal security. In this regard, it is pertinent to mention that such measures represent the most suitable preventive means for ensuring the fulfillment of an obligation. These measures are established in the articles comprising the third section of the second book of the General Organic Code of Procedures. It is important to note that this socio-legal research is primarily focused on precautionary measures of a real nature, specifically those related to tangible assets. In this context, the measures under consideration encompass the following: prohibition of the alienation of real property, seizure, and retention. Lastly, through the employed methodology, which includes surveys, interviews, comparative law analysis, doctrinal examination, along with statistical data, this study demonstrates the significance of incorporating an additional subsection to Article 289 regarding precautionary measures within the General Organic Code of Procedures in standard proceedings, particularly when they pertain to commercial matters. |

Lastly, through the employed methodology, which includes surveys, interviews, comparative law analysis, doctrinal examination, along with statistical data, this study demonstrates the significance of incorporating an additional subsection to Article 289 regarding precautionary measures within the General Organic Code of Procedures in standard proceedings, particularly when they pertain to commercial matters.El presente trabajo de integración curricular se titula: “Las medidas cautelares, en el procedimiento ordinario que regula el COGEP como medida para garantizar el derecho a la tutela judicial efectiva de las partes”, el cual está enfocado en la necesidad de incorporar un inciso al artículo 289 en el Código Orgánico General de Procesos en el que se establezca las medidas cautelares dentro de los procesos ordinarios que versan sobre cuestiones de orden mercantil, tales como letras de cambio, cheques o pagarés que por causa del tiempo prescribieron en vía ejecutiva; tomando en cuenta que dicha disposición de orden legal, no se encuentra tipificada en nuestro ordenamiento jurídico ecuatoriano, por lo que es importante determinarlo en torno al cumplimiento de la tutela judicial efectiva de las partes y a evitar la vulneración del derecho a la seguridad jurídica. En este sentido, es menester traer a colación que, tales medidas son el medio preventivo más idóneo para asegurar el cumplimiento de una obligación, mismos que se encuentran establecidas en los artículos que integran el título tercero del libro segundo del Código Orgánico General de Procesos; tomando en cuenta que esta investigación socio- jurídica se encuentra encaminada en torno a las medidas preventivas de carácter real exclusivamente, en este caso sobre las cosas, siendo aquellas las siguientes: Prohibición de enajenar bienes inmuebles, secuestro, retención.
