description The present degree work is entitled: "Doctrinal and legal study of the educational axis in people deprived of liberty". its importance lies, due to the abandonment of prisons and the constant violation of the rights of persons deprived of liberty in social rehabilitation centers in Ecuador, has generated deficient results in the treatment they receive. The importance of the educational axis consists of a treatment oriented towards the Rehabilitation of the person deprived of liberty, and thus their reintegration into society can be achieved, therefore, this research seeks to verify its compliance and analyze how the educational axis is developed in the prison system in Ecuador. Based on statistical data from the National Service for Comprehensive Attention to Adults Deprived of Liberty and Adolescent Offenders (SNAI), until April 2021, the prison population between men and women reached the figure of 38,614 people. From these figures it is clear that only 2% of people deprived of liberty have taken part in educational, sports, work, etc. programs. Thus, the percentage of Persons Deprived of Liberty who are part of these treatment axes is significantly low. The need to guarantee detainees the Right to Education is of vital importance, not only because this is a right that is the essence of every human being, but also for the personal benefit of who receives education and the auspicious impact of a Human Rights Education in participation and real belonging in society and in the construction of culture within the framework of Human Rights. This work exposes a review of the reality of the penitentiary system based on the public policies applied and the efficiency in the social reintegration of people deprived of liberty. The investigative work was developed using research materials and methods that allowed collecting, processing and concluding the information expressed. To obtain the public perspective regarding the education of the deprived of liberty, use was made of the application of surveys and interviews, were used, carried out with the personnel who work at the Mixed Social Rehabilitation Center of Loja No. 1, teachers from the Private Technical University of Loja and National University of Loja, legal professionals, practicing lawyers and prosecutors. Concluding, this work focuses on the importance of guaranteeing the rights of persons deprived of liberty, strengthening the educational axis through incentives and recognition, that is, rewarding the educational achievements of prisoners with incentives such as sentence 5 reduction, access to additional activities or special recognitions, implement tutoring and support programs where inmates with educational skills can help their peers learn and progress academically, evaluate and monitor the educational progress of inmates and adjust programs as necessary to ensure effective learning, adequate education and a rehabilitative approach.

La importancia del eje educativo consiste en un tratamiento orientado en la Rehabilitación de la persona privada de libertad, y así se pueda lograr su reinserción en la sociedad, entonces, la presente investigación busca verificar su cumplimiento y analizar cómo se desarrolla el eje educativo en el sistema penitenciario en el Ecuador. Basado en datos estadísticos del Servicio Nacional de Atención Integral a Personas Adultas Privadas de la Libertad y a Adolescentes Infractores (SNAI), hasta abril del 2021, la población carcelaria entre hombres y mujeres, alcanzó la cifra de, 38.614 personas. De estas cifras se desprende que únicamente el 2% de las personas privadas de libertad, se han acogido a programas educativos, deportivos, laborales, etc. Siendo así que, el porcentaje de Personas Privadas de Libertad que forman parte de estos ejes de tratamiento es significativamente bajo. La necesidad de garantizar a los detenidos el Derecho a la Educación es de vital importancia, no sólo porque este es un derecho que hace a la esencia de todo ser humano, sino también por el beneficio personal de quién recibe educación y el impacto auspicioso de una Educación de Derechos Humanos en la participación y pertenencia real en la sociedad y en la construcción de la cultura en el marco de los Derechos Humanos. Este trabajo expone una revisión de la realidad del sistema penitenciario en función de las políticas públicas aplicadas y la eficiencia en la reinserción social de las personas privadas de libertad. El trabajo investigativo se desarrolló haciendo uso de materiales y métodos de investigación que permitieron recolectar, procesar y concluir la información expresada. Para obtener la perspectiva publica en cuanto a la educación a los privados de libertad se hizo uso de aplicación de encuestas y entrevistas, realizadas al personal que labora en el Centro de Rehabilitación Social Mixto de Loja Nro.1, docentes de la Universidad Técnica Particular de Loja y Universidad Nacional de Loja, profesionales del derecho, abogados en libre ejercicio y fiscales.
