Summary:The Constitution of the State in its art.229 reza to: rights of the servants and public servants are inalienable. The law will define the governing body in the field of human resources and remuneration for the entire public sector and will regulate admission, promotion, promotion, incentives, disciplinary regime, stability, remuneration system and cessation of functions of your servers. In this case, the servers are governed by the LOSEP. In the organic law of public service and the regulation of the same yet a setback with respect to request leave with pay death a loved one before the above- Described problems decided to develop this research paper entitled: "LA license with remuneration and the need of modify the article 38 LITERAL B of the regulation of LA LOSEP" in which I make a doctrinal analysis of some of the theories of internationally renowned psychologists with regard to the involvement of not living the corresponding duel to the death of a loved one; so also is analyzed legally the Constitution of the Republic of the Ecuador, Ley Orgánica de service public Art. 27 and the regulation of LOSEP Art. 38, managing to show the contradiction between the law and its regulations and the urgent need to amend article 38 of the regulation of the LOSEP, in order to standardize the provisions issued by the LOSEP and its regulations
