Résumé:The present study work is entitled "Public action in crimes against animals of urban fauna, for the effectiveness of the principle of procedural impulse and guarantee of the right to a life free of violence". The interest to develop this work is due to the increase of cruel acts that has been generated in our society in relation to the commission of crimes against animals of urban fauna. This increasing activity is resulting in the lack of protection of these animals and the increase of violence against them. The study shows that crimes against animals of urban fauna, when substantiated as private criminal action, cause impunity in the aspect of applying the corresponding sanctions and penalties typified in the Comprehensive Organic Criminal Code (Código Orgánico Integral Penal). Likewise, an impediment can be evidenced so that the judgment of the person or persons responsible for the infraction can be carried out. The present investigation intends to comply with the constitutional norm that establishes to watch over the rights of nature and that of animals for being part of it. Likewise, it is intended to put into effect the sanctions and penalties in case of committing the crimes established in the Criminal Code. This study work used materials and methods that allowed the development of the research. Interviews and surveys to law professionals essentially, whose results were used to propose the legal reform project to the Comprehensive Organic Criminal Code. The objective of this legal reform is to substitute the exercise of private criminal action for the exercise of public criminal action in crimes against animals of urban fauna, in order to guarantee the care of the physical integrity of the animals, trying to eradicate these illicit acts by means of the application of the corresponding sanctions and penalties.
