| Shrnutí: | This Degree Work "The right to comprehensive health of people with catastrophic illnesses under the Constitutional Jurisprudence of Ecuador" which arises from investigating due to the violation of the rights of people with catastrophic illnesses at the time of access and make their right to comprehensive health effective, so they are obliged to activate the justice system to make it effective. It is aimed at realistically addressing the conflictive scenario in which, on the one hand, the Ecuadorian State is found as guarantor of the human rights inherent to human beings such as a dignified life, health and integrity, on the other hand is the Ecuadorian population. classified as a priority care group such as people with catastrophic or highly complex diseases, including rare or orphan diseases or low prevalence, who feel forgotten, experiencing very profound consequences of their pathologies and the evident lack of action by the Ecuadorian State to make effective what is recognized in a special way in the Constitution of the Republic, and develops it in secondary legislation such as the Organic Law of Health in Chapter IIIA Of catastrophic diseases. The decline that the Comprehensive Public Health Network is currently going through in the context of guaranteeing the right to health is very palpable in the Ecuadorian population, mainly those who suffer from catastrophic diseases, even more so with the presence of the global health crisis covid-19 for which Ecuador, like the majority of countries, was not prepared to face it, consequently the loss of human lives in large masses and materials was evidenced due to the different restrictions to try to maintain social balance. For the development of this Degree Work, different methods and materials were applied that have served as a basis for this research, as well as interviews with legal professionals specialized in Constitutional Law and medicine in the different specialties, the results of which have allowed us to delve more deepen the context of the problems faced by the National Health System and propose guidelines that allow guaranteeing access to comprehensive health for this group of people of priority attention and avoiding their judicialization. |
