Čoahkkáigeassu: | The present degree project is entitled: “Legal and doctrinal analysis on illegal money collection in Ecuador”, which arises from the interest of the complaints made by people harmed by illegal money collectors, or their accomplices are not punished in accordance with the provisions of the Organic Integral Penal Code, illegal money collection is classified as a crime and has a penalty of five to seven years imprisonment. These pyramid schemes, are currently appearing very frequently, and there is a great lack of control by the Superintendencies, in addition, during the last two years due to the Covid-19 pandemic, the country‘s financial system was affected, and technology became at the same time a very important working tool, since these illegal capturers operate by this means, which allows them to make all their dazzling offers visible, so that people think that investing in this way can improve both their personal and family economic situation, unfortunately this form of investment does not guarantee them any legal security of all the money they receive, so this work tries to provide an alternative that would help to solve this problem, where both the perpetrators and their accomplices are punished with proportional penalties, and where the same old tradition is no longer followed, where only the owner of the collectors is punished, because in this way this crime will always remain in unpunished, and nobody will answer for the illegal action committed, nor for the money of the people affected. In this degree project, materials and methods were applied that allowed the development of the research, as well as surveys and interviews with legal professionals, where the results obtained served to propose a legal proposal to Art. 323 of the Organic Integral Penal Code in order to provide a solution to this problem. |
