| Resumo: | For several years in Ecuador, the main economic activity has been around the extractivism of non-renewable resources even though the Constitution of the Republic recognizes the nature’s rights, so the research aimed to analyze the responsibility of the State in the rights of nature violation and compliance with the comprehensive environmental reparation in areas exploited by illegal mining, in La Merced of Buenos Aires, Parish council, Imbabura Province, year 2018, under the technical inspection report No. MAE- DNCA-PRAS-2019-001-TC of july, 2019. The methodology had qualitative approach and was descriptive over the reality of the State limitations that government faces regarding the economic responsibility for environmental reparation. The results obtained after the documental review and law analysis found that there is a violation of nature rights, because in this area, illegal mining was performed that cause loss of vegetation, affectation of the landscape water ecosystem services spoiled, and soil resources damage due to the anti-technical disposal of hydrocarbon derivatives, chemical substances and sterile material. Consequently, the responsibility of the Ecuadorian State is above two aspects, the first as a subsidiary responsible for the lack of identification of the deceased, and secondly as the promoter of nature rights performance by the appropriate legal mechanisms. |
