Gaia:Uncontested divorce emerges as an innovative concept within the legal and sociocultural sphere concerning the dissolution of marriage. This approach does not require proving guilt or justifying specific reasons, as in the legal systems of Latin American countries, the socalled causal system prevails, where couples must demonstrate specific causes, such as abandonment, adultery, or abuse, to request a divorce. The research aims to propose a reform to the current Civil Code to incorporate the legal concept of no-fault divorce in Ecuador. Thus, it was grounded in a qualitative approach, a documentary design, and an analytical synthetic type, carried out through the application of the analytical-synthetic method, which allowed dissecting the issue into parts to arrive at more concrete conclusions. In this way, the attempt is made to positively impact family relationships, protect the rights of minors by proposing a healthier and more viable divorce model rooted in the practice of free will. The study was supported by the historical evolution of divorce, a comparison of divorce in the Ecuadorian, Mexican, and Argentinean contexts. The first chapter addresses the background, while the second chapter conducts a comparative analysis of legislations, and finally, the third chapter proposes a modification to the Ecuadorian Civil Code, thus providing a legal framework consistent with the current characteristics of society
