| Yhteenveto: | This research was based on reflecting from a historical, theoretical and analytical approach the progressivity of the collective right to Indigenous Justice in the Case of Unión Venecia “Cokiuve” during the year 2020, through historical, theoretical and normative compilations around Indigenous Justice that has been reflected in the realities of the peoples and nationalities of Ecuador; In this sense, the analysis of the constitutional regulations, international standards OIT Convention Art. 169 and the Organic Code of the Judicial Function, protect collective rights as well as the exercise of them, for the administration of customary justice and respect for their decisions or resolutions issued by indigenous authorities within their ancestral territories within the scope of their jurisdiction and competence; For this, it was essential to understand and analyze the progressiveness of these rights through the application of the documentary research method, through which relevant information about history of indigenous people and the claim of their rights, jurisprudence and regulations were collected through the instruments of research such as: sentence analysis matrix and structured interviews, which allowed us to reflect on the information obtained in reference to collective, jurisdictional and cultural rights, which are guaranteed by the constitution in order to preserve their traditions and cultures. |
