La idea fundamental es realizar un análisis dogmático – jurídico penal del marco normativo, doctrinario, considerando si la perspectiva ex ante encaja en este tipo de delitos y hacer una breve referencia a la estructura general del injusto, la cual se determina según la función que cumple la norma jurídico-penal. Esta persigue lograr un efecto en la conducta de su destinatario, en el sentido de evitar la producción de un determinado estado de cosas o de lograr la producción de la conducta alguno. La pena establecida por el legislador en el enunciado legal no representa únicamente la definición de la sanción del delito de mera actividad, sino también el medio para influir en el destinatario de la norma.
