El tipo de femicidio en el Derecho Penal ecuatoriano

The research work responded to the problematic situation on the criminal offense of femicide in the correct assessment of the evidence, for which the question of the problem was: What is the scope of application of the crime of femicide in Ecuadorian criminal law? , the idea to be defended is: that through the evaluation of the evidentiary elements, a correct application of the criminal type of femicide is carried out, in order to take into account the approach and gender diversities of minority social groups, thus making , is sanctioned by gender condition, based on social realities. The general objective was to analyze the criminal type of femicide in Ecuadorian criminal law, the methodology used: research approach to apply qualitative, as well as the type of research: legal dogmatic, research design: documentary, together with the methods: analytical - synthetic and exegetical, the technique is documentary review. As conclusions, it is emphasized that the fundamental problem is based on the correct assessment of the evidence that allows determining the power relationship between the defendant and the victim. As recommendations, specialized gender experts should be implemented, as well as gender training for judges, prosecutors, and defenders.
