Summary:The present research work arises from the need to know the problems that daily workers experience when executing their daily work, this was done through an analysis of the main causes that violate the right to work of informal workers in the City of Otavalo. In this way it was determined that the biggest problem for the exercise of the work activity of these workers, is the transgression of their rights by the Municipal Police of the town. To this end, the Constitution of the Republic of Ecuador, the Labor Code, the Comprehensive Criminal Organic Code, the International Treaties and other laws that govern the subject were taken as reference. It was determined that the unemployment existing in Ecuador, forces this group of people to look for this informal activity as their livelihood, which does not allow them a secure economic and working stability, but which nevertheless represents a livelihood for them and their family. It was established what is the responsibility and commitment of the State to avoid the violation of rights by public servants, and what would be the appropriate measures and corrections to avoid this situation. The final purpose of the investigation was to elaborate an "Action Plan" that defends the informal worker against the actions of the Municipal Police of Otavalo, guaranteeing in this way the right they have to work and not to be mistreated in any form of discrimination.
