It is the duty of the State to enforce the rights guaranteed in the constitution, being obliged to repair violations of rights art. 11.9 of the CRE, recognizing that every person has the right to reparation and compensation, to be compensated, to enjoy the reparatory and satisfaction measures contemplated by current law, on such a basis, this article analyzes the existence of anomie in the art. 152 of the COIP and its impunity in the face of comprehensive reparation for victims, when a person due to a traffic accident suffers an injury with disability of less than three days, violating the constitutional right of effective judicial protection, legal security and free treatment. justice, the objective of this article legally established an anomie in article 152 COIP, regarding injuries (transit) with disability of less than three days and their impunity in the face of comprehensive reparation for victims, due to the lack of regulations that do not allows compensation for the damage caused; For this analysis, exploratory, documentary and mixed methodologies were applied; the survey technique, which allowed to strengthen the general objective raised, concluding that there is an anomie in article 152 COIP, regarding injuries (transit) with disability of less than three days, leaving the victim in impunity in the face of comprehensive reparation, verifying that there is a violation of the right to legal certainty, effective protection, allowing the legal analysis to be carried out successfully by fulfilling the proposed objective.
