Summary:The present investigation carried out deals with the contradiction existing in the phrase "That the personal, social and family background" established in the first part of the Numeral 3 of Art. 630 of the Comprehensive Criminal Organic Code with the Constitution of the Republic in its Art. 11 numeral 2; legal precept that requires sine-quanon in the procedure for the conditional suspension of the sentence, thus affecting the constitutional right to equality and non-discrimination; that is why we will leave examining the antecedents and theoretical bases that support the importance of its development, later going on to approach the personal antecedents from the aspects social and family, for this it is important to cite enough doctrine and jurisprudence that objectively bases the essence of the topic addressed, considering excessively what novelty of the subject, since there are no previous studies on the matter.
