| Summary: | The present research project aims to identify the legal foundations related to the right to be forgotten, through which its recognition as a fundamental right within the constitutional scope of Ecuador is possible. Because the information society and the digitization of the physical person become scenarios where the dignity and privacy of the individual are potentially vulnerable. Precisely, the new information and communication technologies (ICTs) and; Above all, the positioning of the Internet together with the so-called managers or search engines have generated that all information that lies on the web assumes the character of perpetual and alien to time. Circumstance from which, those personal data that were published through the network are not exempt; despite the fact that, with the passing of a certain period, they become inaccurate or imprecise references, regarding: the identity of the person in question and / or the current reality through which that man or woman is going through. Faced with these circumstances, the constitutional spectrum of Ecuador requires adapting to the realities that emerge as a result of the so-called Digital Era; In this sense, the recognition of the right to be forgotten as a fundamental right will make it possible to guarantee human dignity within cyberspace; since, it is a variant, in which aspects related to the right to privacy and the right to the protection of personal data converge, which are declared and guaranteed by supranational and national regulations. |
