Through doctrinal analysis and statistics on road accidents, conclusions are reached on the responsibility of the State in the protection of the elderly.El Código Orgánico Integral Penal (COIP) artículo 373, establece la responsabilidad penal de los peatones, pasajeros, controlador u otra persona cuando es el responsable de un accidente y no el conductor de un vehículo, sancionándolo con las penas previstas según sea el caso y las circunstancias de la infracción. Por su parte, el artículo 265 del Reglamento a Ley de Transporte Terrestre Tránsito y Seguridad Vial, consagra que los peatones sean adultos mayores de sesenta y cinco años de edad tendrán derecho a contar con la ayuda necesaria por parte de personas responsables y en especial de los agentes de tránsito, al momento de cruzar las vías públicas. Precisa atender de forma transversal por medio de esta investigación la garantía y protección de los derechos de los adultos mayores ante situaciones de vulnerabilidad y riesgo, por lo tanto, cabe preguntarse como problema de investigación ¿si el adulto mayor que vive desamparado en un área rural en donde no existen agentes de tránsito y que al cruzar la vía pública sea el causante de un accidente de tránsito, puede encontrarse inmerso en la responsabilidad prevista en el artículo 373 del COIP?
