Uso progresivo de la fuerza Policial en la ciudad de Quito en el mes de octubre del 2019.

The events that occurred in the month of October 2019 in the city of Quito, as well as in other Ecuadorian provinces, require the study of the cases in which the legislation authorizes the progressive use of the police force in public concentrations and demonstrations of citizens, when These lead to disturbances that can put the public safety of both people and public and private assets at risk. This is the object of the investigation presented below, to determine whether in the aforementioned events the progressive use of force adhered to the principles contained both in the Constitution of the Republic, in international treaties and conventions and in the Organic Comprehensive Criminal Code, or if by the On the contrary, fundamental rights were violated. The methodology used has been the documentary analysis, both instruments that account for the events of October 2019, as well as the doctrinal articles and the legislation that regulates the matter. Among the conclusions that are noted, the need to evaluate police action in the use of force is highlighted, which will allow a diagnosis of the areas of education and training required by the police authorities in the management of demonstrations and public gatherings, that will allow the correct exercise of the monopoly of force by the State.
