| Sumario: | This paper determines the fundamental rights held by persons deprived of their liberty, and those who are also part of the priority care group, this, based on normative, doctrinal and jurisprudential development, allowing this way, to identify the mechanism of the Ecuadorian constitutional system that in a very short and limited way extends the recognition of these rights. Using for the effect the qualitative approach, through the collection of descriptive and information data, thus allowing to fully analyze, know and interpret the research topic. Persons deprived of liberty are holders of human rights, which are recognized in our Constitution, international human rights treaties or instruments and domestic legal standards, with the exception and, of course, those who refer to free mobility; however, the mechanism by which this recognition of rights would become feasible is poor, and it is demonstrated that the objectives and objectives set out in the so-called Social Rehabilitation System (rehabilitation and social reintegration) are not comply satisfactorily. |
