सारांश:The present study situates the discursive analysis of the criminalization of poverty, having as its main cause the COVID-19 pandemic, a fact that has triggered the massive commission of the so-called trifle crimes, among them, theft and theft within the community. city of Ibarra, province of Imbabura, due to the inequality between the different social sectors, that is, the problem arises and focuses on the ravages of the pandemic within the city of Ibarra, where factors such as unemployment, hunger and change of way of living; they have led citizens to find themselves in the limbo of committing a crime or misdemeanor in order to pay for a basic need; In this sense, it should be taken into consideration that Ecuador is an underdeveloped country, where the COVID-19 pandemic has exposed the violation of various rights of the population, such as the right to health, education, well-being, to employment, among other rights; thus establishing that the main consequence of the COVID-19 pandemic is the increase in poverty of citizens within the territory. The objective of this investigation has focused on diagnosing the incidence of the COVID 19 Pandemic in the criminalization of poverty in crime and theft contravention, in the province of Imbabura, in the year 2020, therefore it has been carried out conducted a documentary review as well as conducting interviews with the Prosecutor's Office, the Criminal Guarantees Unit and a Free Practice Lawyer that serve as support and provide legal and doctrinal relevance to the proposed topic; concluding that the criminalization of poverty is a latent phenomenon through which a criminal policy focused on stereotyping the low-income population as subjects who commit trifle crimes in order to meet their needs is revealed, knowing that they could be sanctioned by the criminal norm, which concludes that in the city of Ibarra there is a high rate of infractions of crimes such as theft and theft, which are judged under the principle of legality applying all the rigor of the criminal norm.
