Sumari:The study analyzes the fulfillment of the right to childhood education in Ecuador according to international human rights conventions. The objective is to examine the inclusion of the human right to education for children and adolescents within Ecuadorian legislation, as outlined in international conventions, by reviewing key content to identify the main challenges in its implementation. Using an analytical, ethnographic, and projective approach, a matrix was employed to evaluate the compatibility between international commitments and Ecuadorian legislation, identifying structural, economic, and cultural barriers that limit implementation. Ecuador has ratified key instruments such as the Convention on the Rights of the Child and the International Covenant on Economic, Social, and Cultural Rights. According to the 2008 Constitution, in transitional provisions 18th and 19th, the State is committed to allocating at least 6% of GDP to education. However, results show a budget shortfall (4.2% of GDP compared to the 6% recommended by UNESCO), inequalities in rural and indigenous areas, and limitations in infrastructure and teacher training. Only 15% of indigenous communities have access to bilingual programs, and 35% of children living in rural areas do not complete basic education. The study concludes that, while there is normative alignment, practical implementation is partial. Recommendations include increasing educational funding, strengthening teacher training with an intercultural and technological focus, and designing inclusive policies to address the identified gaps. These actions are essential to ensure inclusive, equitable, and quality education aligned with international standards and adapted to the national context.
