Резюме:Discrimination on various grounds is given to national and inter national; While the constitutional norm prohibits it. With this research, I detect in our midst if there is discrimination because of age, and persons who suffer this discrimination they feel unprotected and unsafe to face the new landscape that life holds for them after having been fired from their jobs. Since in our country has not faced and presented a solution to this problem, I had to confront our reality with the of neighboring countries, where the discrimination is also given. In this study raise as objective specific to legally substantiate the possibility of reforming the labour code to regulate the work and prevent job discrimination by age. Through surveys and interviews to labour inspectors, lawyers in the free exercise, users of the Inspectorate, etc., after data collection, tabulation and analysis of information obtained concluded that the majority of people is in accordance with the reform of the labour code, for the inclusion of those who suffer discrimination by age , by which concluded preparing a text of reform to article 42, paragraph 33 of the labour code, on par with the disabled be obliged the employer public or private hire at least two people, one with disability and other ages of oscillating between the 40 to 65 years old.
