Adicionar Tag | Resumo: | This document is a research project which raises diagnose the importance of the principle of procedural speed of technical expertise in obtaining the information, it arises regulate article 166 of the Organic Law on Land Transportation, Traffic and Safety Vial; to accelerate the proceedings are instituted and the fundamental rights of the victim is guaranteed for traffic offenses; fundamental human rights of individuals must be protected harmoniously, as it says in the constitution, in order to ensure in practice the effective enjoyment of those rights, so that access to justice, also known by the doctrine as a right to an effective remedy, also it implies the possibility of everyone, regardless of their socioeconomic status, will be treated on equal opportunities, so that road traffic offenses do not go unpunished; so it is very important to be practiced Expert timely research, the cause of basal scene was not contaminated; the goal is to find solutions to the problem, in order to reduce the high rate of traffic offense go unpunished for lack of application of Celerity in the Technical Investigative Expertise, violating constitutional precepts of the victims, justice operators ; it is determined that the expert analysis loses effectiveness when the expert report ignores the most important considerations of fact transit; violating the fundamental rights that the Constitution guarantees the victim of traffic accidents, same as enjoy special protection; their victimization is not guaranteed; Constitutional Rights should also be guided by the principle of universality, equality, equity, progressivity, multiculturalism, solidarity and non-discrimination; to guarantee the rights of the victims of traffic offenses. |
