| Gaia: | This research entitled "environmental pollution caused by power AND ITS IMPACT ON THE ENVIRONMENTAL PROTECTION LAW" aims to present a legal proposal to reform Article 253 of the Code of Criminal Integral where the criminal sanction is increased to environmental crimes as a way to safeguarding the rights of nature and people to have a healthy environment free of contamination. They are efforts being made internally to mitigate pollution in something, despite being a duty of the state to ensure respect for the rights of all people and the environment. Power plants, such as Central de Quevedo, permanently contaminate the environment with toxic gases emissions, jeopardizing the health and deteriorating living conditions. In Ecuador, the environment has huge potential of great biological diversity and extraordinary variety of ecosystems that exist in the territory providing all people access to renewable natural resources required to meet basic needs. In developing this legal research, a methodology based on the emerging paradigm was used, because the focus is immersed in basic situations of collective interest, because it is a problem that affects all humanity, whose priority is to avoid something the systematic deterioration of the conditions of environmental goods and thus be able to cope with the impacts of nature. It is concluded on the need to change their attitude and be part of the solution of problems, likewise should the authorities to assess the levels of pollution generated by power plants. |
