Of the first approach on the investigation carried out work presently has been, projected toward the determination of the problems intrafamiliares and the application of a causal one from divorce to the person that makes family violence according to the consideration of the competent judges of violence intrafamiliares whose information allowed to carry out the analysis and synthesis, induction and deduction, with the purpose of verifying yes the violence intrafamiliar is considered as causal of divorce by the physical, psychological and moral connotation in the nucleus family whose legal instrument bears to solve a partner-juridical desfase. The introduction, the one that refers to the systematic focus from the problem to the argument sustained on the objectives and general vision. In the related to the position of the problem, you can evidence what is determined with the formulation and limitation to the problem. In the concerning thing to the justification, it was formulated taking as indicators the most significant qualities in the problem in the social, institutional aspects, artificial and academic importance, for the development of the investigation. Continuing with the process, it was structured the objectives to reach the achievements of the investigation whose relationship has incidence with the outlined problem, the hypothesis and the theoretical mark. Lastly the artificial proposal is developed based on presenting a reformation to the article 110 of the Civil Code, for tipificar the violence intrafamiliar like causal of divorce
