The present research work, whose subject is: "the jury of extraordinary prescription of dominio viola acquisitive the rights of the legitimate contradictor", had as objective to base in the doctrinal and legal framework the norm contained in the civil legislation regarding the Constitutional Right of the property and the ways of acquiring, among them the extraordinary acquisitive prescription of dominion, legal institution that according as prescribes the legal norm protects in favor of who pretends to acquire a thing of others, without the will of the owner, for having owned it during the time, without violence, clandestinity and more requirements contained in it. it is in this legal context that, although the law establishes that property with registered title does not suffer any action that contradicts the prescribed, based on the argument that the property in any of its forms, constitutes a right that the state recognizes and guarantees for the economy, in addition the law contemplates the possessory action as a way to obtain a right, as it is the extraordinary acquisitive prescription of dominion. it is true that possessory actions are indirect measures of property protection in order to prevent attacks on property or to restore the right through the protection of possession; but also contemplates personal actions, such as the claim, to restore and defend a protected legal right, because the owner has the right to own what is his, and the law is to guarantee that enjoyment.
