| Čoahkkáigeassu: | This legal research work intends to propose amendment to Art. 537 paragraph 1 of the Code of Criminal Integral, which violate the constitutional rights of women breast-feeding. I propose reform, because when a woman breast-feeding, is involved in an offense that merits the judge of criminal guarantees, have no alternative, if not the determining pretrial detention as a precautionary measure, considering this circumstance should be increased house arrest, in order to safeguard the life of the fed who will benefit directly as a priority, to have the general care his mother, proper nutrition with exclusive breastfeeding in the first months of life according to the recommendations of experts from the World Health Organization (WHO). Because of this, the study was conducted in six chapters .- The first chapter helps to know the problematization of this issue and to attaining the objectives with regard to preventive detention that is dictated against women and lactating the baby in its first months of life. SECOND chapter mentions the history that has been made with the issue, many historical and field. Chapter Three. - determines the methods used in the tight inductive, comparative research are the cornerstones for this legal investigation. Chapter fourth analyzes the results of interviews and surveys whose results support my hypothesis. Chapter five. - Develop conclusions and recommendations based on the results investigated. Chapter six reform proposal that will benefit society in general and especially to all women who are lactating. |
