Efectos jurídicos en los matrimonios simulados y su incidencia en la vulneración de los derechos de la familia

In order to get a stay or residence in another country that is not their origin, they have designed new ways to evade the law, as are currently simulated marriages that occur between Ecuadorian and foreign, who get their task and then divorce, violating the legal concept of marriage and constitutional rights. Throughout history the legal social phenomenon of simulated marriages or marriages of convenience, born and are a reality in Spain increasing, especially since 1997, followed by European countries such as Germany, France; and then in Latin America in countries such as Costa Rica, Ecuador, Argentina, etc. The simulated, arranged marriage or as we call it for convenience, I was very popular a few years ago, both the written press and television reporting was given taste abnormalities that were with him such marriages. This is due to the large number of foreigners seeking nationalized and remain living in our territory, marrying Ecuadorians. It is proposed that fake marriages in order to acquire the Ecuadorian nationality, violate constitutional rights, being considered as a criminal offense, as it goes against the good life in general. For this reason, an amendment to COIP proposed in Art. 106, in order to punish such unlawful act.
