This research paper aims to highlight the lack of human rights protection and damage to the environment, which will categorize the protected by the corpus juris environmental good, environmental damage is presented affect a significant component of the ecological heritage of mankind or of a given region, obviously not encounter civil liability for environmental damage. The mining activity in our country has not been so far relevant, however taking a boost once the mining activity has been classified as strategic for the country and its economy, and a large scale of exploitation. The purpose of this work is to encourage a critical debate of human rights and the protection of the environment, which in turn conducive to the generation of proposals and alternatives to the notion of prevailing development in mining and exploitation. When it comes to mining, the most attention focuses on great mining mainly due to their large volumes of production and their investment amounts, is very little attention afforded to the mining production and the damage caused to the environment to the health of the people who engage in this activity especially in its traditional form of exploitation is producing the eminent and irreparable harm. Finally, in this thesis try the right to the protection of the environment and the health of people, doing it through surveys to students and professionals in law and miners, using methods and techniques that go according to this research to obtain the required results. According to crimes and violations committed against the environment and people engaged in this activity that is evolving in our country, we need to develop or create better protection, laws and guarantees necessary for the safety of our environment environments and people working in the mining industry in Ecuador, as currently there are high levels of pollution caused by man, but not only pollutes the man, but there are also some natural factors and benefits, which are detrimental to environment and even their health.
