Sumari:This research work is focused on making a call of attention and demonstrate that it is only the parents who should be brought to responsibility for child support for their children, contrary to the provisions of law, alleging that requires a clear violation the provisions of the Constitution of the Republic of Ecuador, 2008, Article sixty-nine "state Measures to protect the family and its members," the same as in numerals one five establishes the sole responsibility parents, (excluding the grandparents, and other relatives considered forced subsidiary), in the care, breeding, protection, education, food and development of their children. In Article unnumbered 5 of the Law Amending the Code of Childhood and Adolescence, 2009, relating to Book II of Title V, "the Right to Food," in order to adequately protect children that require provision of food, it was established that in case of absence, incapacity, insufficient resources, or disability of their parents who are the primary obligor, the competent authority shall order that the provision of food is paid or supplemented by one or more other family considered subsidiary as required, in view of its economic capacity and provided not disabled are, establishing in its order: grandparents, brothers and sisters and uncles and aunts.
