It was necessary to conduct a field investigation on the basis of some set variables, using techniques such as survey and interview aimed at lawyers in free practice and the Judges and Judges of Children and Adolescents and Teens Attorney offenders City Machala, Public Defender, to diagnose the problem .El desarrollo de la presente tesis titulada JUSTICIA RESTAURATIVA: APLICACIÓN DE LA JUSTICIA RESTAURATIVA Y MEDIACIÓN PENAL EN LOS ADOLESCENTES INFRACTORES DE LA CIUDAD DE MACHALA PROVINCIA DE EL ORO AÑO 2013- 2014, consiste en reformar al IV Libro del Código de la Niñez y Adolescencia e introducir la Justicia Restaurativa para adolescentes en conflicto con la ley penal, cuya finalidad es la reparación del daño causado a la víctima y la reinserción social del adolescente, para lo cual fue necesario realizar un estudio doctrinario de varios autores que se encuentra plasmado dentro del marco teórico, en donde se pretende dar a conocer los beneficios, ventajas de este nuevo modelo de justicia para adolescentes infractores, realizando análisis críticos de las bases teóricas y conceptuales que son la base del presente trabajo. Fue necesario realizar una investigación de campo sobre la base de algunas variables establecidas, mediante la utilización de técnicas como son la encuesta y entrevista dirigidas a los abogados en libre ejercicio profesional y los señores Jueces y Juezas de la Niñez y Adolescencia y al Fiscal de Adolescentes Infractores de la Ciudad de Machala, Defensores Públicos para diagnosticar el problema.
