Tag hinzufügen | Zusammenfassung: | Our research is on a socio-legal problem affecting personal liberty of alcoholics and drug addicts who despite needing urgent attention to the problem of addiction, now considered state of health; therefore entitled to the immediate attention of the Ministry of Public Health, but without affecting their constitutional rights such as personal liberty. Surely all those affected by addictions, should be treated for recovery, but not all voluntarily accept treatment or placement in Recovery Centers, because they minimize their problems and disease, that is where the legal representatives, family members or spouses find a obstacle that must receive attention addicts. Our proposal is that by not having the consent of the addict, it is legally declared interim injunction, establishing the norm, so that those interested in recovering addicts have a legal option, and may their families who suffer addictions receiving specialized treatment centers either in the Ministry of Health or private. Thus avoiding the deprivation of personal freedom is an innate right recognized, which can only be removed when an individual commits a crime or adapt their behavior to a standard deprivation of liberty. |
