Shrnutí:In this research titled analysis and legal interpretation on the probative value of judicial confession, yes eta does not comply with the provisions of Article 123 of the Code of Civil Procedure. Case studies in the canton Arenillas, during the period 2011-2012. Proposal to amend article 124 of the code of civil procedure, we use the scientific method to defend the hypothesis. The significance and legal implications of judicial confession which has not given up on the basis of the qualities listed in Article 123 of the Code of Civil Procedure, do not constitute proof so the act ceases to be perfect reliable, mainly failure parameters exist that indicate what the rules of sound judgment should apply the judge shall, apara appreciate the judicial confession as evidence. This research is to expound that in judicial practice, in several cases, it has breached the principle of legal certainty, the same that among its purposes establishes compliance with the law, which constitutes a flagrant violation of the right of equality guaranteed in the Constitution and in international instruments, being the highest duty of the state to respect and enforce the rights guaranteed by our Constitution.
