| Summary: | The right to due process is characterized as a fundamental right of man as a social being, interacting within society and other social beings, establishing relations of vested social coexistence of rights recognized and guaranteed by the Constitution of the Republic of Ecuador, international treaties and conventions, and other laws of the Republic on condition that the other right delos respected. The application of due process on transit, is vital to enforce the fundamental rights of the litigants. Be a need for a preparatory hearing of judgment in the process to judge traffic offenses that would allow the judge the power to issue an acquittal if it considers that it has proven the materiality but responsibility or vice versa, so the proposal is a means by which will achieve a solution to this procedural problem as fundamental parameter is taken as the basic guarantee of due process. |
