El derecho de familia y su evolución en la legislación ecuatoriana

Abstract:The family has been changing and evolving throughout history, not only at the structural and social level, this has given way to the formation of new family models; due to these changes it has become very difficult to reach a specific definition that includes the variety of existing models. Socially at present the parents do not have the faculty to dispose the future of their children as in the past additional to it the authority exercised by the father is less rigid than in the past on the other hand the separation of couples has increased, violence to family level. Another aspect is the protection by the constitutional, civil, code of childhood and adolescence, through these rules the family is assumed by right in the first instance to give legal coverage through marriage, subsequently the union is in fact regulated as one of the forms of family constitution so that of these two legally recognized options there is no differentiation of legitimate or illegitimate, since both generate similar effects.
