El nuevo código de comercio ecuatoriano: Reflexiones para el debate

This essay aims to describe the main innovations to the Ecuadorian commercial dogmatic that the Commercial Code brings. This initiative acquires greater relevance, and opportunity after the recent promulgation of the new Commercial Code published in the Official Registry Supplement No. 497 of May 29, 2019. The specific objectives are to address the local context in which this body has been issued. Normative and characterize, precisely, the most important innovations that, at the authors’ discretion, are incorporated through the substantive mercantile text. In this sense, the description presented here will address issues that, although they can be presumed preliminary, are fundamental for the academic debate at the national level and that both require the consolidation of the new Ecuadorian commercial or business law. Among the main conclusions, it can be established that the new Commercial Code shows a strong regulatory trend and also tends to harmonize with the tax regime, as well as the control of market power.
