Summary:This article offers several reflections from a gender perspective on the crime of abortion, defined in article 149 of the Ecuadorian Penal Code, and which is currently being examined by the Constitutional Court, after several feminist organizations have filed a claim of unconstitutionality of this figure, claiming that it be the highest body of constitutional control of the legal system regarding the criminal type of abortion. This text proposes, from a feminist legal critique, to reveal the true ideological and political anchoring of this figure through which women have been subjected to stigmatizing judicial processes, maintaining in the social imaginary that the defense of the criminalization of abortion is based on the defense of life.
