It is raised on the specialty of Labor Law since it covers job stability, the relationship of labor dependency between the employer and the worker, the eventual untimely dismissal that the worker may suffer, and finally, the workplace harassment that is internationally called mobbing. Workplace harassment or mobbing is the psychological pressure exerted by the employer through himself or his other workers, on a specific employee in order to the worker steps down voluntarily from his position, thus avoiding that the employer should indemnify the worker on the grounds of untimely dismissal; that is, this harassment occurs to avoid compliance with employer obligations, which is illegal, as it violates the most basic principles of labor law. In the research, the general objective was to determine how the psychological pressure exerted by the employer causes the termination of the employment relationship, for which, a qualitative approach was used that followed a systematic and methodological process whose purpose is to characterize the legal effects that derive from the termination of the employment relationship as a consequence of the psychological pressure exerted by the employer. The methods used were inductive, analytical, and descriptive. In the work development, a documentary-bibliographic source was used; the argumentation is sustained on the current legal regulations, jurisprudence, and doctrine. Likewise, the work is based on field research; it is accomplished under the technique of the survey carried out on Workers, Lawyers, and Labor Inspectors. All contributed to the realization of the main conclusions and recommendations of this work. |
