El delito de sicariato cometido por adolescentes infractores a través del derecho comparado

This article analyzed the phenomenon of contract killing perpetrated by adolescents from a comparative law perspective. It highlights how different legislations perceive juvenile offenders, addressing their criminal responsibility and prosecution concerning contract killing—an offense that does not exist as such in the legal frameworks of countries like the United States and Argentina but has an equivalent adapted to their legal and social reality. Therefore, the objective of this article was to analyze how each legal system prosecutes this crime when committed by juvenile offenders. This research employed a non-experimental, cross-sectional design that combined documentary and field research. Analytical-synthetic and exegetical methods were used to interpret and compare legal norms, complemented by interviews with experts in criminal law. The results revealed that contract killing among juvenile offenders arises due to various factors, including social and family environment, as well as organized crime, which operates within a legal framework focused on reintegration—a system that has been subject to abuse. Finally, the study emphasized the importance of adapting criminal responses to the evolving realities of violence within organized crime while ensuring the fundamental rights of adolescents. The approach must be comprehensive, addressing both prevention and punishment, with a strong commitment to the rehabilitation and social reintegration of juvenile offenders.
