Özet:This article analyzed psychological rehabilitation as a mechanism for comprehensive reparation for indirect victims of traffic crimes resulting in death, focusing on judicial decisions issued in the town of Santo Domingo, province of Santo Domingo de los Tsáchilas, during the year 2023. The main objective of the research was to evaluate how psychological rehabilitation is integrated within the framework of comprehensive reparation and to what extent judicial rulings consider this crucial aspect. A mixed-method study approach was used. A documentary analysis was carried out on the rulings issued during 2023 in the town of Santo Domingo, and interviews were conducted with judges from the Criminal and Traffic Judicial Unit, lawyers specialized in traffic law, and indirect victims of a landmark traffic accident case. The study revealed that, despite the existing regulations establishing comprehensive reparation as a right for victims, judicial decisions in the town tend to focus mainly on financial compensation. This limited approach fails to adequately address the psychological and emotional harm suffered by indirect victims. The findings suggest that psychological rehabilitation, which is essential for the recovery and social reintegration process of victims, is often omitted or considered secondary compared to financial compensation measures.
