Summary:This research work aims to verify the constitutionality that exists in the use and enjoyment of the rights of operators and apprentices of craft workshops, for additional compensation, an express right of workers that is determined in the Constitution force and international treaties and agreements. The operators and apprentices of craft workshops are a social group that is subjected to discrimination is today; that is why, the state first of all and each of its members must contribute to enforce their rights, mainly in the framework of equality and encouraging nondiscrimination toward this important social sector, a cornerstone of economic development. When referring to the additional payments that are denied to the operators and apprentices, I would say that there is at this unconstitutional; therefore, operators and apprentices are more than deserved the right to enjoy the additional benefits like workers in general. In addition, our Constitution as a principle of immediate application, states that all people are equal and enjoy the same rights, duties and opportunities, no one may be discriminated against for any distinction, personal or collective, temporary or permanent, which has the purpose or effect impairing or nullifying the recognition, enjoyment or exercise of rights. This research aims to determine the principle of equality under the Constitution of the Republic in respect of the additional remuneration that are denied them the operators and apprentices of additional workshops, for those granted to workers in general.
