| Samenvatting: | Lesbian, gay, bisexual, trans and intersex people have historically been subjected to discrimination because of their sexual orientation, gender identity and expression and body diversity, and continue to be subject to discrimination, violence, persecution and other abuses; in clear violation of their human rights protected under international and inter-American instruments. One of the main areas where discrimination against LGBTI people has been effective is the workplace. Area in which it has been possible to demonstrate that repetitive and systematically been excluded these from the various stakeholders. Mainly, discrimination towards people GLBTI created stereotypes in the public imagination by which it is considered that the fact of having a sexual orientation or identity of diverse gender reduces the skills and abilities to develop certain jobs, so many people do not want to have individuals in their companies or institutions. These stereotypes preclude the fact that LGBTI people make visible their sexual orientation and gender transgress parameters can access most occupations. Restricting access of these people to those in which it is more acceptable to visualize their sexual orientation and gender transgression. However, in most areas and industrial areas, if a GLBTI want to enter a certain job, it imposes the obligation to pretend a behavior that violates these parameters because, otherwise, it could “damage the working environment "and generate discomfort and problems in the environment. Although it has achieved recognition of the right to equality of persons and non-discrimination based on sexual orientation and gender identity in the Constitution. In everyday society violates the constitutional mandate by the same public officials who are contradicted by saying that seek to ensure compliance with the rights of LGBTI people while disqualify these people. However, the deeply rooted homophobic attitudes, combined with the lack of adequate legal protection against discrimination based on sexual orientation and gender identity, puts many LGBT people of all ages to flagrant violations of their human rights.
