The present investigation carries out an analysis of the protection of the rights of the foreign stateless persons in Ecuador, which have not yet been officially recognized by the Ecuadorian authorities. This study is based on the current national legislation, such as LOMHU and also the main international instruments in the matter. In addition to the above, case studies are also carried out to find out how the Ecuadorian authorities have solved the stateless applications, taking into account that until the year 2016, there was no specific legislation in the matter. In this sense, the investigative work that I propose, takes as a reference the group of foreing stateless persons in Ecuador, in order to know there is or not there is a true protection of the rights of these people, and above all to know how requests of them international protection have been resolved of them same in our country.
La presente investigación, realiza un análisis de la protección de derechos de las personas extranjeras Apátridas en Ecuador, mismas que aún no cuentan con un reconocimiento oficial por parte de las autoridades ecuatorianas. Este estudio tiene como fundamento la normativa nacional vigente, como la LOMHU y además los principales instrumentos internacionales en la materia. Adicional a lo mencionado, también se realizan estudios de casos, para conocer cómo las autoridades ecuatorianas han resuelto las solicitudes de Apátridas, tomando en cuenta que hasta el año 2016, no se contaba con una normativa específica en la materia. En este sentido, el trabajo investigativo que propongo, toma como referencia al grupo de extranjeros Apátridas en el Ecuador, para de esta forma conocer si existe o no una verdadera protección de los derechos de estas personas, y sobre todo saber cómo se han resuelto las solicitudes de protección internacional de las mismas en nuestro país.
