EL DERECHO A LA IDENTIDAD PERSONAL FRENTE AL CAMBIO DE APELLIDO EN PERSONAS MAYORES DE EDAD EN LA LEGISLACIÓN ECUATORIANA

En la Constitución de la República del Ecuador, (2008), en el artículo 66 n. 28, se establece que todas las personas gozamos del derecho a la identidad personal, basado en la libertad de escoger los apellidos y nombres, conservando las características materiales e inmateriales de la identidad, tales como la nacionalidad, la procedencia familiar, las manifestaciones espirituales, culturales, religiosas, lingüísticas, políticas y sociales. El concepto general del derecho a la identidad comprende que es el conjunto de atribuciones y características que permiten individualizarse a la persona en la sociedad. En el presente trabajo de investigación, se pretende analizar el derecho a la identidad personal en las personas mayores de edad, y determinar de qué manera pueden proceder a cambiar su apellido en el Ecuador. Por cuanto permitirá que la sociedad se informe mediante investigación y casos reales sobre los procedimientos en el cambio de apellido amparados en la Constitución de la República del Ecuador, y podrá discernir entre lo que según la ideología planteada por la cultura ecuatoriana actual y vigente es correcto o incorrecto en la ilustración reglamentaria compleja, asimismo dentro de márgenes factibles es preciso que se examine cuáles son los objetivos de las distintas normas legales que se han establecido para regular la conducta y permitir la convivencia sistemática, armónica e integral de las personas.
In the Constitution of the Republic of Ecuador, (2008), in article 66 n. 28, states that all persons enjoy the right to personal identity, based on the freedom to choose surnames and names, preserving the material and immaterial characteristics of identity, such as nationality, family background, spiritual manifestations, cultural, religious, linguistic, political and social. The general concept of the right to identity understands that it is the set of attributes and characteristics that make it possible to individualize the person in society. In the present research, it is intended to analyze the right to personal identity in the elderly, and determine how they can proceed to change their surname in Ecuador. Because it will allow the society to be informed through investigation and real cases on the procedures in the change of surname covered in the Constitution of the Republic of Ecuador, and will be able to discern between what according to the ideology raised by the current and current Ecuadorian culture is correct or incorrect in the complex regulatory illustration, also within feasible margins it is necessary to examine what are the objectives of the different legal norms that have been established to regulate the conduct and allow the systematic, harmonious and integral coexistence of the people.
