LA OBLIGACIÓN PARENTAL Y SUS EFECTOS EN LA REGULACIÓN DEL RÉGIMEN DE VISITAS DE LOS NIÑOS, NIÑAS Y ADOLESCENTES

La presente investigación tiene como objetivo estudiar la obligación parental y sus efectos en la regulación del régimen de visitas de los niños, niñas y adolescentes. En la investigación se empleó el método deductivo, partiendo de los hechos en forma general y llegando a establecer la particularidad del tema. Se utilizó a la encuesta como técnica de investigación, y fue dirigida a los administradores de justicia. El producto final de esta investigación es un protocolo que sustente el criterio jurídico para la imposición de Régimen de Visitas, en el que se propone una equilibrada forma de regulación del régimen de visitas entre los padres e hijos. Se determinó en qué consiste el régimen de visitas y su importancia en el desarrollo integral de los niños, niñas y adolescentes; ya que la norma no conceptualiza a la obligación parental, sin embargo la involucra dentro de las obligaciones y responsabilidades de los padres y madres, y, la inmiscuye en los derechos de supervivencia de los niños, niñas y adolescentes, por consiguiente es importante que el administrador de justicia cree fallos en los que describa a la obligación parental y tutele las relaciones Parento-filiales.
The aim of this research project is to study parental obligation and its effects on the regulation of visitation arrangements with boys, girls and teenagers. In the study, the deductive method was used by drawing from facts in a general way and reaching the establishment of the particularity of the topic. The survey was used as a research technique and was targeted at justice administrators. The final product of this study is a protocol that upholds legal criteria for the imposition of visitation arrangements in which a balanced manner of regulating visitation arrangements between parents and children is proposed. It was possible to determine what visitation arrangements consist of as well as their importance in the integral development of boys, girls and teenagers, since the regulation does not conceptualize parental obligation, nevertheless, it does involve it in the obligations and responsibilities of fathers and mothers. In addition, it interferes in the rights of survival of the boys, girls and teenagers. Therefore, it is important that the justice administrator passes verdicts on those with parental obligation and protects parent-child relationships.
