Cuando se desarrolla el ámbito de la Justicia Transicional generalmente, se observa que las experiencias históricas mantienen contextos comunes que proporcionan a la larga una herramienta clave para definir una de las situaciones más controversiales que se dan al momento de analizar esta temática, y está condición nos pone a resolver la pregunta: ¿qué es más importe para el bien común: el hacer justicia o conseguir la paz?, en esta situación, la construcción a la respuesta de esta interrogante nos lleva a profundizar en el presente artículo un concepto crítico sobre quiénes son las víctimas, cómo se presenta la mutación social de los actores en los procesos de paz, los paliativos legales y políticos que se han perfeccionado en varios países para proteger o sancionar y sobre todo, la necesidad para ajustar los procesos históricos de violaciones de los derechos humanos en los parámetros de los procesos penales en virtud al reconocimiento y reparación.
When the scope of Transitional Justice is generally developed, it is observed that historical experiences maintain common contexts that provide in the long run a key tool to define one of the most controversial situations that occur at the moment of analyzing this subject, and is condition puts to solve the question: what is more important for the common good: to do justice or achieve peace ?, in this situation, construction to the answer of this question leads us to deepen in this article a critical concept about who are the victims, how the social mutation of actors in peace processes, legal and political palliatives that have been perfected in several countries to protect or punish and, above all, the need to adjust the historical processes of violations of human rights in the parameters of criminal proceedings by virtue of recognition and redress.
