THE CRIMINAL POLICY IN THE GOVERNMENT OF THE “CITIZEN REVOLUTION”: FROM PENAL GUARANTEES TO PUNITIVENESS

Criminal policy, understood as the set of decisions in relation to the management of state violence, was manifested in various ways during the so-called “citizen’s revolution”. At first, it could be said that it had a human rights accent, which is reflected in the constitutional norms that established a minimum criminal law and the rights of persons deprived of liberty, in the creation of Public Defense, in the pardon of sentenced persons for micro-trafficking crimes and criminalized by protest. In a second moment there is a punitive turn, which is reflected in policies such as a legal reform that increases crimes and penalties, in the “most wanted” policy, in the construction of prisons with highly restrictive regimes of rights. One of the most notable effects of this policy is that there is an increment of prison population and a divorce between the constitutional norms and the executed criminal policy.
La política criminal, entendida como el conjunto de decisiones en relación al manejo de la violencia estatal, se manifestado de varias maneras durante la denominada “revolución ciudadana”. En un primer momento, se podría afirmar que tuvo un acento garantista, que se refleja en las normas constitucionales que establecen un derecho penal mínimo y derechos de las personas privadas de libertad, en la creación de la Defensa Pública, en el indulto a personas condenadas por delitos de microtráfico y criminalizados por protesta. En un segundo momento se presenta un giro punitivista, que se refleja en políticas tales como una reforma legal que aumenta delitos y penas, en los “más buscados”, en la construcción de cárceles con regímenes altamente restrictivo de derechos. Uno de los efectos más notables de esta política es que existe una sobre población carcelaria y en un divorcio entre las normas constitucionales y la política criminal ejecutada.
